Welcome to Vibe Read! These Terms of Service ("Terms") govern your access to and use of Vibe Read, operated by Summer Engine ("we," "us," or "our"). By using our service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Vibe Read, you confirm that you are at least 16 years of age and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the service.

2. Description of Service

Vibe Read is a reading application that transforms written content into audio format. Our service allows you to:

Save and organize articles from various sources
Convert text content into audio podcasts
Sync bookmarks from connected platforms (such as X/Twitter)
Interact with your content through AI-powered chat features
Use focus mode reading (RSVP) for faster comprehension

3. Your Account

To use certain features of Vibe Read, you must create an account. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Your Content

Ownership: You retain full ownership of any content you submit to Vibe Read. We do not claim ownership over your articles, bookmarks, or any other content you provide.

License: By using our service, you grant us a limited, non-exclusive license to process, store, and transform your content solely for the purpose of providing the Vibe Read service to you. This includes converting text to audio and enabling AI-powered features.

AI-Generated Content: When you use our AI features, we generate outputs based on your inputs. You own any outputs generated specifically for you. We make no warranties regarding the accuracy or completeness of AI-generated content—always verify important information independently.

5. Acceptable Use

When using Vibe Read, you agree not to:

Violate any applicable laws or regulations
Infringe on the intellectual property rights of others
Upload or process content that is harmful, abusive, or illegal
Attempt to reverse engineer, decompile, or hack the service
Use the service to send spam or unsolicited communications
Share your account credentials with others
Circumvent any usage limits or access restrictions

6. Third-Party Services

Vibe Read integrates with third-party services (such as X/Twitter for bookmark syncing) and uses third-party AI providers to power certain features. Your use of these integrations is subject to the respective third-party terms. We are not responsible for the operation or availability of third-party services.

7. Intellectual Property

The Vibe Read service, including its software, design, logos, and documentation, is owned by Summer Engine and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of our service without our written permission.

8. Payment and Subscriptions

Pricing: Vibe Read offers both free and paid subscription plans. Pricing is displayed on our website and may be updated from time to time with reasonable notice.

Billing: Paid subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your plan). You authorize us to charge your payment method automatically.

Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial billing periods, except where required by law.

EU Users: If you are located in the European Union, you have a 14-day right of withdrawal for digital services, unless you have consented to immediate performance and acknowledged the loss of this right.

9. Disclaimer of Warranties

Vibe Read is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure. We disclaim all warranties regarding accuracy, reliability, and fitness for a particular purpose to the maximum extent permitted by law.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Summer Engine shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of Vibe Read.

Our total liability for any claims arising from your use of the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

EU Users: Nothing in these Terms shall limit or exclude our liability for gross negligence, intentional misconduct, death, or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law.

11. Termination

You may stop using Vibe Read at any time by deleting your account. We may suspend or terminate your access if you violate these Terms, upon reasonable notice where practicable. Upon termination, your right to use the service ceases, and we may delete your data in accordance with our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the service at least 30 days before the changes take effect. Continued use of Vibe Read after such notice constitutes acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of Denmark. Any disputes arising from these Terms shall be resolved in the courts of Denmark, without prejudice to your rights as a consumer under applicable EU consumer protection laws to bring proceedings in your local courts.
